Every employee is entitled to their Terms of Employment (Information) Acts 1994–2014 and must receive a written copy of this within 2 months of their start date. Employees are automatically covered by employment legislation and protection which are ‘implied terms’ regardless of whether you provide them with this in writing or not. Furthermore nothing can be written into a contract that denies the employee these ‘implied terms’ but an employer can and should include their own ‘expressed terms’ which extend protection to the employer. These do not have to be complicated but require some careful consideration. Workplace Relations Commission
In 2015 much of the States industrial relations mechanisms were changed and streamlined into what is now the Workplace Relations Commission. This replaces NERA, LRC, EAT and RCS. Prior to this National Employment Rights Authority were responsible for compliance inspections in the workplace, these inspections will now be carried out by WRC inspectors. The purpose of these inspections is to ensure employers are complying with all relevant employment Legislation and SI’s (statutory instruments).
